These Terms & Conditions apply to purchase and use of products and services through the Website operated by Ethnic City. These Terms & Conditions form a contract between you and Ethnic City, and by placing an order through the Website, you agree to be bound by these Terms & Conditions.
1. INTRODUCTION
Our Website offers products and services to consumers and businesses. When you place an order through our Website, you are entering into a legally binding contract with Ethnic City. By placing an order, you agree to these Terms & Conditions and confirm that you have read and understood them. These Terms & Conditions apply to all orders placed through the Website and in placing an order through the Website.
2. ABOUT OUR PRODUCTS
Ethnic City creates culturally inspired products designed to celebrate culture, encourage curiosity and bring people together.
Our products may include Celebration Crackers, gifts, games, activities and other culturally inspired products.
We take reasonable care to ensure that product descriptions, photographs, colours, dimensions and other information displayed on the Website are accurate. However, colours may appear slightly different depending on your device or screen, and reasonable variations may occur between product photographs and the actual product.
Where a product contains multiple components or gifts, we reserve the right to make reasonable changes where necessary, provided that the replacement is of equivalent or better quality and does not materially change the nature of the product.
3. PRODUCT AVAILABILITY
All products are subject to availability.
Adding a product to your basket does not guarantee that the product will remain available until you complete your purchase.
If a product becomes unavailable after you have placed an order, we will contact you as soon as reasonably practicable.
If we are unable to fulfil your order, we will cancel the affected order and provide a full refund of any amount you have paid for the unavailable product.
4. PRODUCT SAFETY
Certain Ethnic City products, including our Celebration Crackers, contain a cracker snap and small or functional items.
Celebration Crackers are Category F1 products and are not to be sold to persons under 12 years of age.
Celebration Crackers must be used in accordance with the safety instructions provided on the packaging and on the relevant product page.
In particular:
- They must be sold as packaged.
- They are suitable for indoor use.
- Do not pull crackers near the face, eyes or ears.
- Do not remove the snap or pull the snap outside of the cracker.
- Pull both ends firmly and sharply at arm's length.
- Celebration Crackers contain small parts and functional items which may present choking or sharp-point hazards.
- They are not suitable for children under 36 months.
- Adult supervision is required.
- Please retain the safety information supplied with the product for future reference.
You must not use any product for a purpose for which it was not intended or contrary to the instructions supplied with it.
5. PRICES
All prices displayed on the Website are in pounds sterling (£) unless otherwise stated.
The price payable for your order will be the price displayed at the time you place your order.
Any applicable delivery charges will be displayed separately before you complete your purchase.
We reserve the right to change our prices at any time. A price change will not affect an order that we have already accepted.
If we discover an obvious pricing error before accepting your order, we will contact you to confirm whether you wish to proceed at the correct price. If you do not wish to proceed, we will cancel the order and refund any amount you have paid.
6. PLACING AN ORDER
You can place an order by selecting the products you wish to purchase and completing the checkout process.
Before completing your purchase, you will have an opportunity to review your order and correct any errors.
By clicking the order confirmation button at checkout, you confirm that you wish to purchase the products in your basket and agree to pay the total amount displayed.
You will receive an email acknowledging that we have received your order.
This acknowledgement confirms receipt of your order but does not necessarily mean that we have accepted it.
7. ACCEPTANCE OF YOUR ORDER
A contract between you and Ethnic City will be formed when we confirm that your order has been accepted.
We reserve the right not to accept an order where, for example:
- the product is unavailable;
- we are unable to obtain or verify payment;
- there is an obvious pricing or product description error;
- we reasonably suspect fraudulent or unauthorised activity; or
- we are unable to deliver to the address provided.
If we do not accept your order after payment has been taken, we will refund the amount paid.
8. PAYMENT
Payment must be made using one of the payment methods available at checkout.
Payments may be processed by third-party payment providers. Payment card details are processed by the relevant payment provider and are not stored by Ethnic City in full.
Your payment provider may have its own terms and privacy policy, which will apply to its processing of your payment.
We may carry out reasonable payment and fraud-prevention checks before accepting an order.
9. CUSTOMER ACCOUNTS
You may create an account on the Website to make future purchases easier and to access your order information.
You are responsible for keeping your account login details confidential and for all activity carried out through your account.
You must notify us promptly if you believe that someone has accessed your account without your permission.
We reserve the right to suspend or close an account where we reasonably believe that it has been used fraudulently, unlawfully or in breach of these Terms & Conditions.
You may also choose to place an order without creating an account where guest checkout is available.
10. DELIVERY
We currently deliver to UK mainland addresses only.
We do not currently offer delivery to Northern Ireland, the Scottish Highlands and Islands, the Channel Islands, the Isle of Man or international destinations unless expressly stated at checkout.
Available delivery options and charges will be displayed at checkout.
Estimated delivery times are provided as guidance and are not guaranteed delivery dates unless expressly stated otherwise.
Once your order has been dispatched, we may provide tracking information where the selected delivery service provides tracking.
You are responsible for providing a complete and accurate delivery address.
We will remain responsible for the goods until they are delivered to you or to a person you have identified to receive them on your behalf.
If your order is delayed, appears to have been lost or has been delivered incorrectly, please contact us at celebrate@ethnic-city.com and we will investigate the matter.
11. DELIVERY DELAYS
We will make reasonable efforts to dispatch and deliver your order within the estimated timeframe provided.
Where no other delivery period has been agreed, goods will be delivered without undue delay and, in any event, within the period required by applicable law.
We are not responsible for delays caused by circumstances outside our reasonable control, including courier disruption, severe weather, natural disasters, industrial action, transport disruption, government restrictions, supplier disruption or other events beyond our reasonable control.
Nothing in this section affects your statutory rights.
12. CANCELLING YOUR ORDER
If you are purchasing as a consumer, you generally have a legal right to cancel your online order within 14 days of receiving the goods, without giving a reason.
If your order contains multiple goods delivered separately, the cancellation period will generally begin when you receive the final goods.
To exercise your right to cancel, you must notify us within the applicable cancellation period.

You may simply tell us that you wish to cancel your order and provide your order number.
For example:
"I wish to cancel my order [ORDER NUMBER]."
You do not have to use this exact wording.
13. RETURNING CANCELLED GOODS
If you cancel your order under your statutory cancellation rights, you must normally return the goods to us within 14 days of telling us that you wish to cancel.
Unless the goods are faulty, damaged, incorrectly supplied or we otherwise agree, you will normally be responsible for the direct cost of returning the goods.
Celebration Crackers — Important Return Information
Ethnic City Celebration Crackers are single-use products containing a cracker snap. Once a cracker has been pulled, it has been used and cannot be restored to its original unused condition.
If you are considering cancelling your order because you have changed your mind, please do not pull, fire or otherwise use any of the crackers or their contents.
You may inspect the product as reasonably necessary to establish its nature, characteristics and functioning, in the same way that you might reasonably inspect a product in a shop. However, you should not pull the crackers, remove or activate the snaps, or use the gifts or other contents if you intend to exercise your cancellation right.
If you pull a cracker, use its snap, remove or use its contents, or otherwise handle the product beyond what is reasonably necessary for inspection, this may reduce the value of the product.
If you subsequently cancel your order and return a product that has been used or handled beyond what is reasonably necessary for inspection, we may make a deduction from your refund to reflect the actual reduction in value of the returned product.
This reduction may be significant because our Celebration Crackers are sold as a complete box of six crackers. If one or more crackers have been pulled or otherwise used, the remaining crackers may no longer constitute a complete, unused product that we can resell as new.
The amount of any deduction will therefore be assessed based on the actual condition and resale value of the returned product.
Returning the Product
Celebration Crackers should be returned in their original retail box where possible. If the original box is unavailable or unsuitable for return, the goods must be securely packaged in packaging of equivalent protective strength to minimise the risk of damage during transit.
Nothing in this section affects your statutory rights where goods are faulty, damaged, incorrectly supplied or otherwise do not conform to your legal rights.
14. REFUNDS
Where you validly cancel an order, we will provide the refund required by applicable law.
This will normally include the cost of our least expensive standard delivery option. If you selected a more expensive delivery service, we are not required to refund the additional amount.
We will normally issue refunds using the same payment method used for the original transaction unless we agree otherwise with you.
Where goods are being returned, we may withhold the refund until we have received the goods back or you provide evidence that you have returned them, whichever occurs first.
Once we have authorised a refund, your bank or card provider may take several working days to make the funds available to you.
15. DAMAGED, FAULTY OR INCORRECT PRODUCTS
Nothing in these Terms & Conditions affects your statutory rights.
If your product arrives damaged, is faulty, does not match its description or you have received the wrong product, please contact us at celebrate@ethnic-city.com.
To help us investigate the issue, we may ask you to provide:
- your order number;
- a description of the problem; and
- photographs of the product and packaging.
We will assess the issue and provide an appropriate remedy in accordance with your legal rights. Depending on the circumstances, this may include a repair, replacement, price reduction or refund.
You are not required to give up your statutory rights because you have accepted delivery of or opened a product.
16. NON-RETURNABLE OR NON-REFUNDABLE PRODUCTS
Certain products may not be suitable for return where they have been opened, used or are no longer in a condition that allows us to resell them, subject always to your statutory rights.
We will not use this provision to restrict your legal rights to cancel, return or obtain a remedy for faulty, damaged, incorrectly supplied or misdescribed goods.
17. PROMOTIONAL CODES AND DISCOUNTS
From time to time, Ethnic City may offer promotional codes, discounts or other special offers.
Unless expressly stated otherwise:
- promotional codes must be entered at checkout;
- only one promotional code may be used per order;
- promotional codes cannot be exchanged for cash;
- promotional codes cannot be applied retrospectively to completed orders; and
- promotional codes may be subject to additional terms, exclusions or expiry dates.
Promotional codes may not be combined with other offers unless expressly stated.
We reserve the right to withdraw or amend a promotional offer where reasonably necessary, but this will not affect a discount that has already been validly applied to an accepted order.
18. FIRST-ORDER DISCOUNT
Where offered, our first-order discount is intended for new Ethnic City customers making their first qualifying purchase.
The offer is subject to the specific terms displayed with the promotion and may not be combined with other promotional codes unless expressly stated.
Ethnic City reserves the right to refuse or remove a discount where there is reasonable evidence of misuse, including repeated creation of accounts for the purpose of obtaining multiple first-order discounts.
19. EVENT PROMOTIONAL CODES
Promotional codes distributed through Ethnic City events, flyers or other promotional materials may be subject to specific terms, including an expiry date or minimum order value.
The terms applicable to the promotion will be communicated with the relevant code.
Unless expressly stated otherwise, event promotional codes cannot be exchanged for cash or applied retrospectively to previous orders.
20. BUSINESS AND CORPORATE ORDERS
Ethnic City also accepts orders from businesses and corporate customers.
Where you purchase products wholly or mainly for business purposes, you may not have the same statutory consumer cancellation rights that apply to consumers.
Business and corporate orders may be subject to additional terms agreed with Ethnic City, including agreed pricing, quantities, payment terms, delivery arrangements and cancellation provisions.
Where an order is placed through the standard Website checkout without separately agreed business terms, the terms displayed at checkout and these Terms & Conditions will apply.

21. INTELLECTUAL PROPERTY
All content on the Website, including text, photographs, graphics, illustrations, logos, product designs, branding and other materials, is owned by or licensed to Ethnic City unless otherwise stated.
Ethnic City® is a registered trademark of TBD Management Ltd.
You may use the Website for your own personal, non-commercial purposes.
You must not copy, reproduce, modify, distribute, sell or commercially exploit Website content without our prior written permission.
22. USER REVIEWS AND CONTENT
If you submit a review, photograph, comment or other content to Ethnic City, you confirm that:
- the content is your own or you have permission to use it;
- it does not infringe another person's intellectual property or privacy rights;
- it is not unlawful, defamatory, misleading or offensive; and
- where other people appear in photographs or other content, you have any necessary permission to submit that content.
We reserve the right not to publish or to remove content that does not comply with these requirements.
23. WEBSITE AVAILABILITY
We aim to keep the Website available and operating correctly, but we do not guarantee that the Website will always be available, uninterrupted or error-free.
We may temporarily suspend or restrict access to the Website for maintenance, security updates, technical issues or other operational reasons.
24. OUR LIABILITY
Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited.
This includes liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation; or
- defective products or other matters where the law does not allow liability to be excluded or limited.
Nothing in these Terms & Conditions affects your statutory consumer rights.
Subject to the above, we will only be responsible for losses that are reasonably foreseeable and arise from our breach of these Terms & Conditions or our failure to exercise reasonable care and skill.

28. EVENTS OUTSIDE OUR CONTROL
We will not be responsible for failure or delay in performing our obligations where this results from an event outside our reasonable control.
Such events may include natural disasters, severe weather, fire, flood, epidemic or pandemic, industrial disputes, transport disruption, government action, war, civil unrest, supplier disruption, courier disruption or failure of utilities or telecommunications.
Where such an event affects your order, we will take reasonable steps to minimise the impact and keep you informed where reasonably possible.
Nothing in this section affects your statutory rights.
29. CHANGES TO THESE TERMS & CONDITIONS
We may update these Terms & Conditions from time to time.
The version applicable to your order will be the version displayed on the Website at the time you place your order.
We will not use a change to these Terms & Conditions to retrospectively alter the terms of an order that we have already accepted.
30. GOVERNING LAW
These Terms & Conditions are governed by the laws of England and Wales.
If you are a consumer living elsewhere in the United Kingdom, you will also retain the benefit of any mandatory consumer protections that apply to you under the law applicable to your circumstances.
31. YOUR STATUTORY RIGHTS
Nothing in these Terms & Conditions is intended to restrict, exclude or remove any rights you have under applicable consumer protection legislation.
Consumers have statutory rights in relation to goods, including rights that goods must be as described, of satisfactory quality and fit for purpose.
If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, that provision will be treated as severed to the extent necessary, and the remaining provisions will continue to apply.
